MY PASSION FOR REMOTE WORK

Remote work is not only my business, it's my passion. I received recognition in the legal industry for my in-roads in the remote workspace in 2018 when I won the 2018 Lawyers Weekly Women in Law Thought leader of the Year Award. 2019 has seen more industry award nominations via being named as a finalist in the Australian Law Awards Regional Law Firm of the Year and Sole Practitioner of the Year Categories for the Remote Expert.

With postgraduate qualifications in organisational change management and human resources, I understand what makes a business tick and how remote work can improve your bottom line. I also pride myself on cutting the B.S and speaking to you in a language you can understand in the most efficient way possible. The Interactive Work Health & Safety (WHS) Audit is a must have for organisations to ensure that workers who work remotely (whether it be one day a week or all of the time) have their safety obligations covered in their remote workspace. The fact an employee works from home does not mean the employer ceases to have responsibility for their health and welfare while they are doing their job. For this reason, it is crucial that employers: establish where in the home the employee will work; and retain a checklist and photos of the employee’s workspace, including the ergonomic benefits and placement of furniture, exits and other safety requirements.

This interactive checklist brings together all of these requirements for your peace of mind. Allow your employees to work from home with confidence by purchasing this product (per employee) and providing them with the online form link to your remote team member.   Ask the remote team member to print, read and complete the Interactive Work Health & Safety Audit and take photos of the remote workspace to upload as part of the form.

The Remote Work Policy contains guidelines to set expectations and boundaries for any team members working away from your office. The Remote Work Agreement (non award) is a template employment agreement for an employer wanting to employ a remote employee. It is suitable for a wholly remote or partly (hybrid) remote employee. Available in Word version, you can badge with your business logo and proceed with confidence to be sure your organisation is taking into account all remote working issues.

By using a specialised remote work agreement template the Employer and the Employee will be clear on:

  • Where the employee will work from;
  • Who is responsible for workplace health and safety (WHS) obligations in the remote workspace;
  • How employee expenses are claimed/ paid (and whether the employee is permitted to claim certain items as expenses);
  • Who is to supply the equipment required for the role;
  • The hours the employee will work; and
  • Other specific arrangements such as the frequency the employee is to visit head office.

If the role you are hiring for is covered by a Modern Award and/ or your employee plans to work outside of the usual Award Hours please be aware that this arrangement could attract penalty rates under the Modern Award. The Variation of Employment Agreement for Remote Work is a template contract designed to vary an existing Employment Agreement to permit the employee to work remotely some or all of the time. Available in Word version, you can badge with your business logo. The Variation to Employment Contract (Remote Work) provides a written record when an existing employment agreement is varied by:

  • Outlining the agreed remote work arrangements;
  • Setting boundaries around the remote work arrangements (such as the need for child care during work hours and the day/s the employee is expected to work in the Head Office/ office environment);
  • Implementing a trial (or probationary) period of the remote work arrangement inbuilt so both parties can determine if the remote work arrangement is suitable;
  • Detailing arrangements for data and equipment security;
  • Considering reimbursement of remote work expenses; and
  • Covering off Work Health and Safety considerations for remote employees.

If your employees work from home regularly (even as little as one day a week) getting this variation is a sensible idea to ensure your insurance and work health and safety obligations are met and to provide the employee with clear guidance around the work boundaries for the at-home work.

The Remote Work Casual Employment Agreement is a template employment agreement for an employer wanting to employ a remote employee as a casual worker. It is suitable for a wholly remote or partly (hybrid) remote employee. The Remote Work Contractor Agreement is a template contractor agreement where the Contractor will be providing work to the Principal (business) remotely. Available in Word version, you can badge with your business logo and proceed with confidence to be sure your organisation is taking into account all remote working issues where a contractor is concerned.

By using a specialised remote work contractor agreement, the parties to the agreement will be clear on things such as:

  • The general terms of the agreement including length of contract, project price;
  • Remote access to IT Systems; and
  • Confidentiality

Note that in Australia, an independent contractor’s agreement does NOT create the same employment relationship between the parties as an employment agreement. As a result, a contractor remains responsible for superannuation, insurance tax and other leave entitlements and can only collect the agreed Price under the contractor’s agreement, unless the Superannuation Guarantee Threshold is reached and the principal must pay superannuation to the contractor.

Before using this template, we suggest you review the Australian Tax Office guidelines for an independent contractor to ensure that your proposed contracting arrangement will not be classed as an employee and employer relationship.
